After being involved in a car accident where I sustained back injuries, I was informed by my lawyer that the party at fault would cover the damages to my vehicle. The lawyer also advised me to settle the case for $23,000, which was meant to cover my bodily injuries, hospital bills, therapy, suffering, and personal distress.
However, I continued to experience significant back pain despite undergoing therapy. I expressed my concerns about my ongoing pain and asked what would happen if I decided to pursue further action against the at-fault driver in the future. I was told that I could still sue the driver separately after the settlement. Sadly, over the year, my lower back pain had been transformed onto a sciatica issue which has no ultimate cure.
Unfortunately, after signing the release agreement and accepting the settlement, I discovered that I am now barred from pursuing any further claims against the driver for my injuries. This information was not clearly communicated to me prior to closing the case, and I feel misled by the firm.
I believe it is crucial for clients to fully understand the implications of settlement agreements, and I wish I had received clearer guidance from Sergent Law Firm regarding my rights after accepting the settlement.
